A few weeks ago, not much was said when it was noted that Big Meech of BMF plead guilty to money laundering & running a continuing criminal enterprise. Even Meech himself spoke in low tones according to reports. Outside of federal investigators putting in years of work, one other important factor helped put the nail in the coffin for Meech and other BMF ringleaders. At the same time, given the publicity & circumstances surrounding T.I.’s case, our attention focuses again to one thing.
The snitch.
Ever since Henry Hill, those in the criminal underworld have played the game, benefited immensely and, when shit hit the fan, they used snitching as an escape clause.
With all of this in mind, I went to Ethan Brown, author of Queens Reigns Supreme, to give me his take on the case, since I knew he had been following the case based on having read his article “Mo’ Money, Mo’ Problems” originally featured in Vibe magazine. For the benefit of our readers, I asked Ethan to give us some insight on what he felt made snitching such a prominent part of America’s current drug trade. In a nutshell, it wasn’t that the people or the “rules” regarding the daily aspects of the drug trade changed. A huge part of it is that federal legislation & sentencing laws helped foster snitching.
1) The Anti Drug Abuse Act of 1986
The bill stipulated a 5 year mandatory minimum sentence for trafficking in 5 grams of crack (5 grams is equivalent to the weight of a nickel). Those caught trafficking in powder cocaine received the same 5 year sentence if they trafficked in 500 grams of the drug. Similarly, the Anti Drug Abuse Act of 1986 mandated a 10 year sentence for those caught selling 50 grams of crack while those who trafficked in 5,000 grams of powder received the same 10 year sentence. These huge disparities in sentencing for crack and powder cocaine related offenses are commonly known as the “100:1″ ratio. Unsurprisingly, the effect of the sentencing disparities between crack and powder and resulted in long prison terms for thousands of black men. One federal judge in New York actually called such sentencing policies “The New Jim Crow.”
2) The Anti Drug Abuse Act of 1988
The pinnacle of the drive toward extraordinarily punitive drug laws: this bill established a 5 year sentence for simple possession of five grams of crack.
It’s worth noting that both the Anti Drug Abuse Act of 1986 and 1988 were passed during periods of drug panic. The ’86 bill was passed after the drug overdose of UMD basketball star Len Bias. The ’88 bill was enacted after the killing of NYPD officer Edward Byrne at the hands of henchmen working for Southeast Queens drug kingpin Lorenzo “Fat Cat” Nichols. These bills were NOT given any real thought or consideration. As Ohio State University law professor Douglas Berman recently wrote, these laws were “passed quickly and without reflection.”
3) Section 5k1.1 of the sentencing guidelines and Rule 35 of the Federal Rules of Criminal Procedure. Section 5k1.1 of the sentencing guidelines was enacted in late 1987. It provides huge reductions in sentences for defendants who provide “substantial assistance” to federal prosecutors. Since most drug defendants in the federal system faces serious prison time because of the sentencing guidelines, just about everyone snitches in order to get what’s dubbed the ’5K Letter’ from a prosecutor. And because sentences are so long there’s a huge motive to lie and fabricate evidence in order to get that much coveted ’5K Letter.’ This is where the snitch game begins. The sentencing guidelines have created a scenario where you can be involved in the drug game, get caught by the feds and then roll over on whomever you feel like in order to get a drastically reduced sentence for yourself. Worse, most times federal prosecutors allow snitches to choose targets.
Another big tool for snitches: Rule 35 which allows defendants to provide information about others more than one year after they are sentenced. The practical effect of this law is to basically allow someone sitting in prison to concoct information about someone else and then reduce their sentence drastically.
It’s time to re-direct anger away from individual snitches and toward the criminal justice system itself. The snitch game simply would not exist without these insane sentencing guidelines which have helped create a massive system of prisons and jails in America that now incarcerates nearly 1.5 million people (in 1970, there were less than 200,000 in prisons and jails in the U.S. This is an eight fold increase which makes us the world’s leading jailer!). They’ve been trying to change the Rockerfeller Drug Laws in New York for years. I think they were ammended somewhat, but they are still severe. My Uncle just came home from doing 7 joints & He was just a runner. These laws end up giving low level dealers kingpin level time with hopes of getting someone to tell.
Edwards came here to Omaha, and talked about that, the jail sizes. He impressed me because he didn’t get on trying to make new laws or stop violence or “war on drugs”. He went right in saying that he wants to help the poor (no need to sale) and the schools to educate (smart enough not to use), and prevent the kids from going to jail. He’s nipping it in the bud. Smart tactic in my opinion.

I got peoples who been and still locked up, and you know what? They all deserved it. I love em all to death, but you chose to do foul and got caught, be a man about doing your time.
I grew up in Queens hearing all the stories about Supreme, Fat Cat, Pappy, Rich, Alpo, AZ, etc. etc., so I couldn’t help but have some admiration for the hustler, but bottom line, no matter how noble your intentions may be, no matter how many mouths you have to feed, you still destroying lives and taking money out of someones pocket. And chances are you probably doing it to your own peoples.

I eat 1 packet of instant oatmeal for breakfast, usually a cup of noodles for lunch then hit the dollar menu for dinner. My only fam is 3000 miles away. IM HUSTLIN LEGALLY EVERYDAY. I GRIND 24/7 but legally. I cant afford lawyers or bail so doin jailtime is not an option for me. I cant even take that gamble. I break plenty of laws daily but none that will get any significant jailtime . I used to sell drugs, but here in Nevada selling even a nickel bag of mexican pissweed gets you a felony. So I stopped answering phone calls from buyers. I decided trying to build a profitable drug business is not the way to go. so now Im trying to build a legit business.

I asked my paster about snitching. And in actuality, it’s both wrong and right to snitch. Some snitch out of envy (“that ninja didn’t get caught, so he gonna get it now”), which is wrong. And some snitch because “Tre” sold to “Ray’s” mother. That shouldn’t even be called snitching. That’s being smart and reponsible; be a man, protect your family. Something Cam’ claimed he wouldn’t do.

As for me I do both, legal/illegal and if I get caught I’ll smile at the judge and do my time because I refuse to go hungry. Bottom is if you live that life go big and don’t get locked up for minor stupid shit, and if you do get locked up don’t blame the system and cry about shit, just man up and do your time.

I think when your talking about narcotics its a whole different game then say racketering, gambling, etc (usual organized crime) I think you can look at prohibition when mobsters were moving Liquor into the states from Canda, Mexico, etc and relate that to the drug game. Theres alot more violence when it comes to drugs and it was the same during prohibition (alcohol) (St. Valentines Day Massacre) Cats cant stay organize when it comes to shit that makes em lose there sober state of minds.Thats why it worked better when drugs were minnimal, back when Luciano and Lanksy formed the Commision and murder was alot less prevalent in the game. You get these “Kingpins” using there own product, turning there brain to shit, thinking there untouchables, its Stupid.Thats why Lanksy and Luciano were the last of their kind, one died ofa heart attack long after he was a force, and the other eventually died of natural causes. These guys will rot in prison for the rest of there lives or get killed….no intelligence anymore.

I’ve been impacted from many sides of the crack-era fallout. I have close family members, some younger than my age of 29, doing very hard time for drug related offenses, or violations of prohibitive conditions that follow from from drug-related convictions/offenses. So no disrespect to anyone caught up, or their fam. I also have a lot of affected family members from what you may call the “user” or “collateral damage” side. There are multiple “victim” roles that drugs can put people in, and I tend to feel the most sorry for those who didn’t have a choice in their current drug-related outcome. I’ll expound, out of everyone I know hurt by, or caught up in, the drug game or its ramifications, the person/people I feel the worst for are my younger black male and female cousins who are the children of addicts, current or reformed. In the spirit of the honesty shared by Gotty, the cat in vegas, and to a lesser extent AmpGeez, I myself fall squarely in this group as well.
to that point, just last night I was back in “the old hood” (east oakland) to let me pops and stepmom see my son. Stepped outside to have a cig, and saw one of my favorite female cousins walking from way down the block. Long story short, she is a active addict of heroin and I don’t know what else. Selling her body, stealing, the whole 9. Now I love her to death, and we were close like big and puff during my Sr year of high school. Being around her and some of her reformed-hustler guy friends actually helped me to be so not in awe of the dealer life or accolades. At the time her boy was 7, maybe 10, curious and full of life. As has been the case with me at points in my life (but not now, thank God), both of his parents are hardcore addicts. He is about 16 now, his grandmother on his dad’s side is raising him, and he’s still crazy about his mom, even though she’s strung out and hard to look at.
So, I say all that to say I really feel sorry for the kids of the addicts. I have many memories of addicts trying to sell me their children’s xmas gifts right in front of the children. I had to find the right tone with which to admonish the parent, but not further embarass the kid. Hard. Plus these kids end up being conditioned to think that it’s ok to be hard core criminals b/c they are embarassed, malnourished, undereducated, and sometimes addicted to stimulants from birth. Very bad cycle here.
I also feel bad for the actul addicts. Again, Hustling via dope is in no way a victimliess crime. I firmly believe that the reason the “masses” don’t rock w/ Mos, or the Roots, or Immortal, or even Tribe, chose so because they can’t handle the hustlers-ethos being trashed directly and indirectly. I grew up listening to Chuck D, one of our greatetest orators. Didn’t my peers? How could his message(s) (see Night of the living baseheads) be convoluted into somethign that’s corny, etc? I’m lost on that one.
So by default, I feel the least amount of sympathy for the dealer (who may in turn, be the grown up child of addict. again, sad.).
So, not to discredit the power or intention of the government or the media, or whatever organization is planning the next 10 years via a remote polar ice-cap location, but people, especially Black and Colored Men, need to take more responsibility for their OWN actions.
And not to take shots, but Amp sounds a little young, and still heavily influenced by the music he puts in his ears, the images he sees on tv, and the re-popularized (see: American Gangster series) myths of criminals of years past.
I hate to butcher a good Chris Rock joke, but too many of us are hell bent on “Keeping it Real”, yeah, real dumb.

From The News Hour…it seems these rulings give more power to judges and take away from the 1986 and 1988 acts which are where the unfair guidelines come from.
To those who are hoping to see people out early…I dont know. The problem is the old sentences were already handed down by judges or juries, so I think you’d have to sue and argue that the sentences were previously unfair, or appeal for clemency or parole based on good behavior, and hope for a judge. That would seem possible under this ruling.
nyt.com ruling announced today, should ease the crack/coke divide going forward. Should.

Pat – there’s a lot of things still up in the air as far as will people actually be freed as a result. But I can tell you that those who are locked up have been keepin up w/this for a LONG time & have their appeals paperwork ready.
We’ll just have to wait & see. W/20,000 affected by it & all the paperwork that’ll come w/that, it could be a legal nightmare.
There are crimes of passion and crimes for profit. Penalties for violating any law are supposed to provide an incentive to NOT do a given crime. Rational behavior says that the more severe the penalty, the more the incentive to not do the crime. I know very little about drugs and the drug trade but here is something to consider.
By reducing the penalty, the incentive to not do the crime is also being reduced. Given someone can make money doing the activity with less penalty, then more people will enter that business (that is, after all, what it is… a business).
Who are the customers? Who’s buying the drugs? If they are members of the community where the drugs are being sold and that community is a black community then which is more racist; removing those dealing in drugs from the community or reducing the penalties and reducing the incentive to NOT use/deal drugs?
To have a lower expection or standard for any segment of society over any other segment is one of the worst forms of “stealth” racism that has existed for many, many years… It does nothing other than help keep that segment down.
How come young jeezy is not involved in all of this ?
Is he one of the coopoeration witnesses ?

The issue is complex, but the bottom line is that this is America, and capitalism fuels the FLAMES. Prison is big business and people make money off of the criminals and victims. The rich feed off the poor (think Sub-Prime loan crisis) and real changes won’t be made to the justice system until people start looking at the big picture.
